Analysis of 2015 NYTS data on 6-12th graders exposes many false claims by CDC, finds:
(note that ‘frequent’ use = 20+ of past 30 days, and ‘infrequent’ use = <20 of past 30 days)
– frequent smokers were 84 times more likely than never smokers to vape daily (16.9% v 0.2%)
– infrequent smokers were 36 times more likely than never smokers to vape daily (7.3% v 0.2%)
– frequent smokers were 73 times more likely than never smokers to vape frequently (21.8% v 0.3%)
– infrequent smokers were 41 times more likely than never smokers to vape frequently (12.2% vs 0.3%)
– frequent smokers were 12 times more likely than never smokers to vape in past 30 days (64.7% v 5.5%)
– infrequent smokers were 9 times more likely than never smokers to vape in past 30 days (50.4% v 5.5%)

In 2016, Villanti et al revealed the 2014 NYTS found <0.1% of never tobacco users in 6th-12th grades reported vaping on 10 or more of the past 30 days

– Require DHHS/FDA to impose a TCA authorized tobacco product advertising regulation limiting vapor ads to primarily adult media, and a TCA authorized tobacco marketing regulation that prohibits vending machines and self-service vapor sales in stores that allow youth access;
– Require DHHS/FDA to “promulgate final regulations” by March 2019 “to require” TCA authorized tobacco product warning labels on vapor products saying “Keep out of reach of children”, “Underage Sale Prohibited” and listing the product’s nicotine content;- Change the predicate date for all FDA Deemed products (not just vapor) from 2/15/2007 to 8/8/2016, which would likely result in FDA issuing SE Orders for <1% of FDA registered 8/8/2016 vapor products (i.e. those sold by tobacco companies that already received SE Orders from FDA for tobacco products);
Enactment of Cole-Bishop could also negatively impact the lawsuits challenging/opposing FDA’s Deeming Rule in federal courts, and would make in nearly impossible to convince Congress to enact legislation that establishes reasonable and responsible vapor product standards and allows most vapor products to remain legal (e.g. Duncan Hunter’s bill – HR 2194)
