NIDA funded NBER study estimates that 10% (i.e. 350,000) additional smokers would have quit smoking had FDA not proposed and imposed its cigarette protecting 2016 Deeming Rule, estimates a federal television ban on e-cigarette advertising would have further reduced the number of people who quit smoking by 3% (i.e. by 105,000 smokers).

The main findings of PHE’s evidence review:

–  vaping poses only a small fraction of the risks of smoking and switching completely from smoking to vaping conveys substantial health benefits

–  e-cigarettes could be contributing to at least 20,000 successful new quits per year and possibly many more

–  e-cigarette use is associated with improved quit success rates over the last year and an accelerated drop in smoking rates across the country

–  many thousands of smokers incorrectly believe that vaping is as harmful as smoking; around 40% of smokers have not even tried an e-cigarette

–  there is much public misunderstanding about nicotine (less than 10% of adults understand that most of the harms to health from smoking are not caused by nicotine)

–  the use of e-cigarettes in the UK has plateaued over the last few years at just under 3 million

–  the evidence does not support the concern that e-cigarettes are a route into smoking among

young people (youth smoking rates in the UK continue to decline, regular use is rare and is almost entirely confined to those who have smoked)

US Vaping Ignorance Keeps Increasing (due to lies and vapor sales bans by DHHS since 2009)

NCI’s 2017 HINTS found 55.6% of American adults inaccurately believe vaping is just as or more harmful than cigarette smoking, just 4% correctly know vaping is much less harmful.

In contrast, the 2013 HINTS found 39.8% inaccurately believed vaping is just as or more harmful than cigarette smoking, while 9.4% correctly knew vaping is much less harmful.

National Academies Report

FDA contracted National Academies report promotes FDA’s vapor Deeming Ban, but admits:


– vaping is far less harmful than smoking cigarettes, and

– the health of vapers will worsen if they switch back to smoking cigarettes.

Unfortunately, the irreconcilably biased and conflicted NA committee engaged in research misconduct by excluding and ignoring all evidence that has consistently confirmed:

– daily and past month cigarette smoking rates by teens declined >50% as vaping increased,

– exponentially more teens smoked cigarettes before vaping (than who vaped before smoking),

– virtually all frequent nicotine vapers have been and are either current or former smokers,

– vaping has helped millions of smokers quit, and helped millions more reduce smoking, and

– FDA’s 2016 Deeming Rule threatens the lives of several million vapers and 40 million smokers (by banning all new vapor sales and truthful health claims about vaping on 8/8/2016, by banning sales of ALL lifesaving vapor products on 8/8/2022, and by allowing FDA to ban them sooner).

Jill Daly: Evidence on health effects of e-cigarettes is mixed, expert panel says (Godshall cited)

A longtime critic of research that labels e-cigarettes and vaping a gateway to tobacco smoking for young people, Bill Godshall, executive director of Smokefree Pennsylvania, attacked the committee’s report, saying, “This is a repeat of all the junk science that’s been done already.”

A proponent of vaping as a path to quit tobacco smoking, Mr. Godshall said, “There are a thousand times more people who have quit smoking using vaping products than people going from vapers to cigarettes.”

He added that studies have not asked young people if they had smoked before vaping, only if they had smoked a cigarette at least once after previously vaping.

He suggested the findings might have been different if there was a harm-reduction expert on the committee. He also said randomized, controlled trials, while accepted as the highest quality in testing medical treatments, can’t reproduce the experience of vaping.

“There are over 3 million e-cigarette products registered with the FDA,” he said.

“The average vaper has switched from dozens of vaper products since they’ve quit smoking,” he said. Surveys show the success of vaping, he said, adding that surveys show most teens aren’t vaping with nicotine.

I’m Bill Godshall, founder and executive director of SmokeFree Pennsylvania, which has campaigned to reduce cigarette smoking since 1990 by reducing secondhand smoke exposures, reducing cigarette marketing to youth, holding cigarette companies accountable, and increasing cigarette taxes. 

Since 2004, we’ve also informed the public that cigarettes cause >99% of all tobacco attributable morbidity, disability, mortality and healthcare costs, and that smokefree alternatives are below 2 on the Continuum of Risk in which cigarettes are 100 and NRT products are 1. 

We’ve also advocated keeping ALL low risk smokefree alternatives legal to manufacture, market and use, which is why we opposed the Tobacco Control Marlboro Monopoly Act that was negotiated and agreed to in 2004 by Philip Morris, RWJF financed Matt Myers and then-GSK lobbyist Mitch Zeller, which banned sales of new smokeless tobacco products more than a decade ago.     

We also opposed Josh Sharfstein’s unlawful cigarette protecting 2009 FDA e-cigarette import ban, and Mitch Zeller’s 2016 cigarette protecting Deeming Rule that banned sales of all new vapor products 18 months ago, banned truthful health claims for vapor products, and bans all vapor products in the near future (unless the Deeming Rule is significantly changed).    

For disclosure, neither I nor SmokeFree Pennsylvania have ever received any funding the US DHHS or from any tobacco, drug or vapor company. So no financial conflicts.

Recent studies indicate Marlboro HeatSticks & IQOS are about 90% less harmful than cigarettes.  But far more extensive scientific and empirical evidence has consistently found snus, moist snuff, dissolvables and vapor products are about 99% less harmful than cigarettes.

So why is FDA considering approving MRTPs for Philip Morris Marlboro products that appear 90% less harmful than cigarettes after FDA banned the sale of vapor products that appear 99% less harmful than cigarettes, have already helped millions of Americans quit smoking (something FDA & CDC have refused to acknowledge), and have helped cut youth smoking in half since 2010?

And why has FDA refused to accept 367 PMTAs, but is considering PMTAs for Marlboro HeatSticks?

A key reason is because Philip Morris and Altria spent hundreds of millions of dollars lobbying to enact the 2009 Tobacco Control Act and to impose FDA’s 2016 Deeming Rule because both policies protect Marlboro’s Cigarette Monopoly and Marlboro HeatSticks from market competition by thousands of small smokeless tobacco and vapor companies that cannot afford $100 million to submit PMTA and MRTP applications.

If FDA approves MRTPs and PMTAs for Marlboro HeatSticks, PM and Altria will spend hundreds of millions of dollars more to protect their new Marlboro HeatStick Monopoly by lobbying to keep vapor products banned, including the Cole-Bishop bill in Congress.

Before creating another multi billion dollar Marlboro monopoly, the FDA should rescind its disastrous Deeming Rule that bans millions of lifesaving vapor products, and begin to truthfully inform the public that ALL smokefree tobacco/nicotine alternatives are far less harmful than cigarettes.

Farsalinos/Gillman analysis of 32 studies that compared carbonyl emissions in vapor aerosol and cigarette smoke finds carbonyl emissions in vapor aerosol were substantially lower than those in cigarette smoke whenever realistic use conditions were ensured, but find the vast majority of the 32 studies did NOT control for dry puff conditions (i.e. they didn’t replicate human exposures).

Regulator Watch: Study shows no lung damage from vaping

Japan Tobacco study finds secondhand emissions (i.e. exhaled by user) from its heat-not-burn product had no impact on indoor air quality, finds concentrations of ETS markers, toluene, total VOC and CO were below limits of detection or below limits of quantification.

2018 Federal Spending Bill

American E-Liquid Manufacturing Standards Association (AEMSA) sends letter urging Congressional leaders to exclude Cole-Bishop amendment from 2018 federal spending bill (because it requires FDA to issue a Final Rule for “a product standard for vapor products” “to include but not limited to” “characterizing flavors” and “batteries” by January 2021, which could ban virtually all vapor sales more than a year before the Deeming Rule would in August 2022).

Evolution of Cole-Bishop language

Introduced in May 2015, the Cole bill (HR 2058) only changed TCA’s 2007 predicate date for Deemed tobacco products (including vapor products)

Introduced in 2016, the Cole-Bishop amendment to the House spending bill would have changed the 2007 predicate date, would have required FDA to propose a standard for vapor product batteries within 12 months and issue a Final Rule within 24 months after issuance of Deeming Rule, and would have restricted print advertising to publications primarily read by adults.

US THR Surveillance

NIDA funded 2017 Monitoring the Future (MTF) survey finds:
–        New record low lifetime, past month and daily cigarette smoking rates among US teens,
–        Past 30 day cigarette use fell to 1.9% among 8th graders, 5.0% among 10th graders, 9.7% among 12th graders,
–        Daily cigarette use fell to .6% among 8th graders, 2.2% among 10th graders, and 4.2% among 12th graders,
–        3.5% of 8th graders, 8.2% of 10th graders, and 11.0% of 12th graders vaped nicotine in past 30 days,
–        Among the 27.8% of 12th graders who vaped in the past year and were asked what they inhaled the last time they vaped, 51.8% said “just flavoring”, 32.8% said “nicotine” and 11.1% said “marijuana” or “hash oil”.







CDC issues select 2016 NHIS vaping data, finds:
– 1.2% of US adults (2.97M) were “daily” vapers in 2016;
– 3.2% of US adults (7.93M) were “current” e-cigarette users (i.e. every day or some days), down from 3.4% in 2015, and down from 3.7% in 2014;
– E-cigarettes were used “every day or some days“ by 4.5% of 18-24 year olds (1.41M), 4.2% of 25-44 year olds (3.56M), 2.9% of 45-64 year olds (2.44M), 1.0% of 64+ year olds (.48M); and
– 15.4% of US adults (38.16M) had ever used an e-cigarette.


Brad Rodu: 2016 CDC data shows e-cigarette use declines again, finds
– 7.8 million currently used e-cigs,
– 3.9% (4.5 million) of men currently used e-cigs, and 2.6% (3.3 million) women did so,
– former smokers accounted for 34% of “current” e-cig users, up from 30% in 2015, and from 22% in 2014.

Brad Rodu: New Vaping Insights Based on FDA’s PATH Survey 2013-14

Rodu/Plarphanswat analyze FDA 2013-14 PATH adult survey data, find:
– 5.6% (12.9M) of US adults were either current e-cigarette users or triers, including 2.4% (5.5M) e-cig users and 3.2% (7.4M) e-cig triers,
– 1.0% (2.3M) of US adults vaped daily, 1.4% (3.2M) vaped on some days, 3.2% (7.4M) were current e-cigarette triers,
– 0.3% (.7M) of US adults were both former cigarette smokers and former e-cig users, accounting for 26.9% of former e-cig users, and indicating that many smokers who quit smoking by switching to vaping also subsequently quit vaping,
– 45.7% (1.1M) of daily vapers were former smokers, 27.7% were daily smokers, 19.0% were some day smokers, 3.8% were current cigarette triers, 3.3% were former cigarette triers, 0.5% were never cigarette smokers,
– 61.5% (2.0M) of some day e-cigarette users were daily smokers, 13.0% were some day smokers, 9.5% were former smokers, 9.3% were current cigarette triers, 5.0% were former cigarette triers, 1.8% were never cigarette smokers,
– 62.3% of current e-cigarette triers were daily smokers, 13.2% were some day smokers, 6.4% were former smokers, 10.7% were current cigarette triers, 5.6% were former cigarette triers, 1.8% were never cigarette smokers.

Brad Rodu: More vaper insights from FDA PATH 2013-14;

Rodu/Plarphanswat analyze FDA 2013-14 PATH adult survey data, find top reasons for vaping:

  1. “less harmful to me” (94%),
  2. “less harmful to persons around me,” (88%)
  3. “help to quit smoking,” (86%)
  4. “don’t smell” (80%)

2013/14 FDA PATH adult survey data finds use of e-cigarettes among smokers and former smokers was significantly higher than use of FDA approved NRT products, use of e-cigarettes was only the smoking cessation method other than unassisted quit attempts with higher odds of being a former smoker.

Brad Rodu – Population Level Proof: E-cigarettes are popular and successful quit-smoking aids

Study of 15,532 recent cigarette smokers (since 2010, which included 75% current smokers and 25% former smokers) from 2014/15 NHIS data finds:
– 52% of daily adult vapers in the US have quit smoking since 2010, compared to 28% who never vaped, and to 12% of some day vapers;
– daily vapers were 3.18 times more likely to quit smoking since 2010 than never vapers;
– daily vapers accounted for 10.7% of former smokers, but just 3.3% of current smokers.





2014/15 CPS-TUS survey of US adults found regular vaping (i.e. 20 or more of past 30 days) was reported by 12.7% of former smokers (<1 year), by 7.4% of former smokers (1-3 years), by 3.6% of current smokers, and by just .1% of never smokers; found 7.7% of adults ever used an e-cig, 2.1% currently used e-cigs (i.e. at least once in past 30 days), and .9% regularly vaped.

Study of CDC NATS data finds the number of US adults who switched from cigarettes to vapor products increased 100% from 2012/2013 to 2013/2014

Study by former CDC OSH director Michael Eriksen et al finds nicotine was vaped by 81% of US adult smokers who vape, but just by 37% of adult non smokers who vape.

Although many surveys have found that many vapers do NOT vape nicotine, the US DHHS still falsely classifies all vapor products as “tobacco products” and everyone who vapes (including those who vape just flavors, CBD and/or THC) as “tobacco users”.

Canadian THR Surveillance

2016 Canada survey confirms vaping has NOT renormalized smoking, finds:
– cigarette smoking by youth (12-17) declined to 3.6% (from 4.1% in 2015),
– smoking by 12+ year olds declined to 16.9% (from 17.7% in 2015, and 20.9% in 2012),
– 3.7 million Canadians smoke daily (down from 3.8 million in 2015, and 4.5 million in 2012)

UK THR Surveillance

Young People’s Use of E-Cigarettes across the United Kingdom: Findings from Five Surveys 2015-2017 finds:
– Just 1%-3% of 11-16 year olds in the UK regularly use e-cigarettes at least weekly,
– Among regular cigarette smokers, 7%-38% regularly use e-cigarettes,
– Among never smokers, 0.1%-0.5% regularly use e-cigarettes,





French THR Surveillance

Survey of French university students finds:
– 12% of former smokers, 5% of current smokers, and 0.3% of never smokers were current e-cig users,
– 9% of former smokers and 2% of current smokers were daily vapers,
– just 3.3% of current and former smokers used an e-cig prior to smoking cigarettes,
– although 13.2% of never smokers ever used an e-cig, just 0.3% currently used e-cigs,

Snus Saves Lives: A study of snus and tobacco related mortality in the EU

“In total and among men over the age of 30, 355,000 lives per year could have been saved if the other EU countries had matched Sweden’s tobacco-related mortality rate. Sweden clearly has the lowest tobacco- related mortality rate within the EU in relation to its population despite daily tobacco consumption among men being at the same level as other countries in Europe.” “In 24 of the EU’s 27 member states, the tobacco-related mortality rate is more than double that of Sweden, relative to their population size.”

San Diego State study finds vaping not an indoor air pollutant, finds leading causes of indoor air pollution (i.e. PM 2.5) in California homes are cigarette smoke, marijuana smoke, vacuuming/dusting/sweeping home in past week, frying food and burning incense/candles; “We observed no apparent difference in the weekly mean particle distribution between 43 homes reporting any electronic cigarette usage and those reporting none.”  See Tables 4 & 5

But indoor air pollution study abstract and San Diego State’s press release touting the study never mentioned the study’s key finding (i.e. vaping NOT an indoor air pollutant)

Study finds cigarette smokers who vape (dual users) were far more likely than exclusive smokers (25.9% vs 11.2%) to reduce cigarette consumption by 50+% after six months, and were far more likely (22.8% vs 10.9%) to make a quit attempt of at least 7 days, further documenting the health benefits of vaping by cigarette smokers (i.e. dual use).

But authors falsely claim “It remains unclear whether regular e-cigarette users are also more likely to stop smoking.”

Smoking in EU

– Sweden (7%) and UK (17%) have lowest smoking rates (due largely to THR products).

– Largest smoking declines since 2006 were in Sweden (from 18%) and UK (from 34%).

– Greece (37%), Bulgaria and France (36%), Croatia (35%) have highest smoking rates.

– While 25% of EU residents 15+ and 24% of Swedes 15+ use tobacco daily, 24% of EU residents 15+ smoke daily compared to 5% in Sweden (where snus has been legal).

– 91% of smokers in the EU smoke daily compared to just 52% in Sweden.

– 26% of EU residents 15+ smoke cigarettes, cigarillos, cigars or pipe, but 24% do daily.

– EU cigarette smokers consume an average of 13.7 cigarettes per day.

– Few EU residents 15+ smoke cigarillos (3%), cigars (2%) or pipes (1%), and just 1% smoke any of these products daily.

Smokeless Tobacco Use in EU

– Just 5% of EU residents 15+ ever used low risk smokeless tobacco compared to 50% in Sweden (due to the EU’s cigarette protecting snus ban that Sweden is exempted from).

– <1% of EU residents 15+ use low risk smokeless tobacco daily compared to 20% in Sweden, 2% in Finland and 1% in Denmark.

Vaping in EU

– 4% of exsmokers in the EU currently vape, including 14% in UK, 7% in Ireland, 6% in France and Belgium, 5% in Greece, but just 0% in Spain, Lithuania, Latvia, Slovakia and Luxemburg, and just 1% in Germany, Italy, Poland, Sweden, Portugal, Romania, Bulgaria, Slovenia, Estonia, Netherlands and Cyprus.

– 4% of smokers in the EU currently vape, including 8% in France & Belgium, 7% in Austria, Denmark & Luxumbourg, 6% in UK, Germany, Malta & Cyprus, but just  0% in Germany, Italy, Sweden, Hungary & Croatia, and 1% in Romania, Slovakia & Slovenia.

– Among current vapers in the EU, 67% vape daily, 20% vape weekly, 7% vape monthly.

– Among current vapers in the EU, 47% vape fruit flavors, 36% vape tobacco flavor, 22% vape menthol or mint flavors, 18% vape candy flavors, and 2% vape alcohol flavors.

– Among ever users of tobacco and e-cigarettes in the EU, just 1% used e-cigarettes first (disproving the Big Lie that e-cigs are gateways to cigarette smoking).

Smoking Cessation in EU

– Among exsmokers in the EU, 81% quit smoking without assistance, 7% quit with Big Pharma drugs, 6% quit by vaping, and 4% quit with medical advice or cessation service.

– Among EU smokers who have tried to quit, 66% tried to quit without assistance, 16% tried Big Pharma drugs, 15% tried e-cigarettes, 6% tried medical or cessation services.

Note the EC report authors asked biased questions about vaping and smokeless tobacco, and presented skewed findings (e.g. by using “ever use” data in the denominator) to demonize low risk vapor and smokeless tobacco, and to discredit them as cessation aids.

DHHS funded tobacco control extremists Peter Shields et al urge FDA to make cigarettes more harmful (by banning cigarette filters), cite increase of one type of lung cancer (after filters were added to cigarettes) but ignore significant overall decline in lung cancer, heart disease and all cause death rates among smokers (after filters were added to cigarettes).

DHHS financed Peter Shields (who authored recent US tobacco cessation guidelines that falsely claims vaping doesn’t help smokers quit smoking) urges FDA to ban filtered cigarettes, claims doing so will reduce lung cancer rates among smokers.

News media hype claim by DHHS funded Peter Shields et al that filtered cigarettes increased cancer rates among smokers, and that banning filters would reduce cancer rates, without any fact checking and without interviewing any objective experts that disagree.

22nd Century touts US government purchase of 2.4 million additional very low nicotine cigarettes, touts DHHS funded junk studies of very low nicotine cigarettes to promote FDA cigarette prohibition (i.e. by banning sales of all cigarettes except  22nd Century’s very low nicotine cigarettes, which smokers won’t buy or smoke)



Trump says Francis Collins will stay on at the NIH

In January 2017, NIH Director Francis Collins deceptively touted FDA’s vapor Deeming Ban and Stan Glantz’ lies about vaping, and made the following false claims:

– vaping causes asthma and respiratory infections (despite zero scientific evidence),
– teen e-cig use is increasing (except the 2016 MTF found a 29% decline since 2014),
– there is “no evidence” e-cigs have contributed to sharp decline in youth smoking

– e-cigs have addicted more teens to nicotine (after the 2015 NYTS found <.1% of teen never tobacco users had used an e-cig on 10 or more of past 30 days)

US DHHS Budget

Trump Administration budget for DHHS mentions tobacco harm reduction in FDA CTP’s title (pg 18) REDUCING THE USE AND HARMS OF TOBACCO and description “decreasing the harms of tobacco product use”, but still falsely claims “Tobacco use is the leading cause of preventable disease, disability, and death in the United States” (as daily cigarette smoking, not tobacco or nicotine use, is the leading cause of all those things); CTP’s budget increase is from user fees by tobacco companies.

Trump budget would reduce funding for NIH (pg 36), which has intentionally deceived the public about THR products for decades, and gave more than a billion dollars to hundreds of anti-THR researchers/activists at dozens of universities to demonize and misrepresent risks of lifesaving vapor products, very low risk smokeless tobacco, nicotine, flavorings, cigars/pipes, and lobby for the TCA (2000-2009), FDA’s vapor bans (2009-present), vaping/tobacco use bans, banning nearly all nicotine in cigarettes, etc.

Trump budget reduces CDC’s Chronic Disease Prevention and Health Promotion funding (pg 28), much of which was wasted by Obama’s CDC to deceive the public about THR products and to lobby for FDA’s Deeming Reg, vaping and smokeless tobacco usage bans. Trump budget also reduces Prevention and Public Health fund (pg 28), that was used by Obama’s CDC to deceive the public about very low risk THR products and to lobby for vaping bans, smokeless tobacco use bans, FDA’s Deeming Regulation, etc.

Note that CDC’s Prevention and Public Health Fund spent $495.3 million since 2012 on “Tobacco Use Prevention” (i.e. $126M-2016, $111M-2015, $105M-2014, $60.3M-2013, $93M-2012), and Tobacco Use Prevention funds’ purpose was: “To raise awareness and shift key attitudes and beliefs about the harms of tobacco use and exposure to secondhand smoke in areas of the country with some of the highest rates of tobacco use prevalence.”







Big Pharma financed CTFK’s Matt Myers makes many false fear mongering claims about Trump’s budget impact on CDC’s ability to reduce smoking, deceitfully conflates lifesaving vapor products and very low risk smokeless tobacco with deadly cigarettes

Vapor prohibitionist Legacy lies initiative’s Robin Koval hypocritically calls Trump’s budget “a reckless threat to defund essential programs that address the number one cause of preventable death in our country”, while deceitfully conflating the negligible risks of vaping and smokeless tobacco use with the very high risks of cigarette smoking.

ASH UK 2017 survey of adult vaping in Great Britain (England, Scotland, Wales) finds:

– 1.5 million of GB s 2.9 million vapers have quit smoking,

– 9.5% of ex-smokers vape in 2017 compared to just 1.1% in 2012,

–  .3% of never smokers vape in 2017 compared to .1% in 2012,

– 52% of GB vapers are exsmokers

– 45% of GB vapers are current smokers,

– 3% of GB vapers are never smokers,

– 6% of GB vapers vape >20mg/ml nicotine (that is now banned by the EU TPD, and that will reduce smokers  chances of switching to vaping and quitting smoking)

– the growth of vaping among GB smokers has slowed down sharply,

– 20% of GB vapers vape >4ml of e-liquid daily (bottles of which were recently banned by the EU TPD)

– just 13% of GB adults now correctly believe vaping is far less harmful than smoking cigarettes, compared to 21% in 2012, (due to fear mongering lies by vapor prohibitionists that have been deceitfully touted as facts by Big Pharma shills, medical associations, etc.)
