Vapor Education and Advocacy

Keller and Heckman E-Vapor and Tobacco Law Symposium, February 6-7, 2018 in Irvine, CA

UK Parliament Science and Technology Committee holds hearing on e-cigarettes January 9

1st Panel Witnesses: Peter Hajek, Mark Conner, Riccardo Polosa; 2nd Panel Witnesses: Lion Shahab, Jamie Brown, Paul Aveyard

The first panel will focus on relative harmfulness of e-cigarettes compared to cigarettes, and assessments of whether different types of e-cigarettes have a varying health effect on the user.

The second panel will explore the appropriateness of using e-cigarette as a smoking cessation tool, and the possible role of e-cigarettes in “re-normalising” smoking.

Linda Bauld: The evidence keeps piling up: e-cigarettes are definitely safer than smoking;

But misinformation and scaremongering could still be putting people off switching.

THR Surveillance

CDC reports 2016 NHIS data finding significantly more young adult males use e-cigs “every day or some days” than young adult females

THR Research

Farsalinos/Gillman analysis of 32 studies that compared carbonyl emissions in vapor aerosol and cigarette smoke finds carbonyl emissions in vapor aerosol were substantially lower than those in cigarette smoke whenever realistic use conditions were ensured, but find the vast majority of the 32 studies did NOT control for dry puff conditions (i.e. they didn’t replicate human exposures).

Regulator Watch: Study shows no lung damage from vaping

Japan Tobacco study finds secondhand emissions (i.e. exhaled by user) from its heat-not-burn product had no impact on indoor air quality, finds concentrations of ETS markers, toluene, total VOC and CO were below limits of detection or below limits of quantification.

Study of 40 dual users (of cigarettes and vapor products) and 175 exclusive vapers (who completely switched from cigarettes) finds dual users had reduced their mean cigarette consumption by 82% after 22 months, and dual users vaped less e-liquid than exclusive vapers.

Smoking cessation study (in which smokers were given standard tobacco treatment for 8 weeks, and were given nicotine patches, behavioral counseling, and either a nicotine or non nicotine e-cigarette as needed) finds half of those who quit smoking were still vaping after six months.

Fontem Venture’s two year study on users of its Puritane e-cig finds declines in smoking and cigarette consumption, decline in adverse events, no safety concerns.

Modeling study finds higher e-cigarette prices reduce e-cigarette use and increase current cigarette consumption among youth, and that “on average e-cigarettes reduced youth smoking”.

Carl Phillips: New paper reports inaccuracies in e-liquid nicotine labels

Smokeless tobacco prohibitionists find lower risk smokeless tobacco is replacing cigarette smoking in India, Bangladesh and Nepal, but then advocate more anti THR policies to discourage millions of other Asian smokers from switching to lower risk smokeless products

Foundation for a Smoke Free World

VOA hypes CTFK’s criticism of PMI funding for Foundation for a Smoke Free World, but fails to reveal CTFK was created with $35 million from Big Pharma in 1995 and has received most of its funding from Big Pharma since then to protect and promote sales of ineffective and less-than-safe smoking cessation drugs, and to demonize and lobby to ban, restrict and tax low risk smokeless tobacco, snus, dissolvables, vapor products, and heat-not-burn products.

After the Foundation for a Smoke-free World invites 344 researchers/organizations to apply for grants, the Wire demonizes Derek Yach by hyping criticism from longtime THR opponents who vehemently oppose smokers quitting smoking by switching to low risk smokefree alternatives

Charlie Minato: Ten questions for 2018 (includes question/discussion about Cole-Bishop and large cigar exemption amendments to FY 2018 spending bill)

CTFK’s Matt Myers complains that 2018 federal spending bill slashes anti-THR propaganda programs of Obama’s CDC that have demonized vaping, smokeless tobacco, nicotine and THR.

FDA falsely claims vapor flavorings lure and are illegally marketed to youth in title and abstract of yet-to-be proposed Advanced Notice of Proposed Rule Making (ANPRM), just as the agency falsely claimed in 2009 when it unlawfully banned the import of vapor products into the US.

Iowa AG Tom Miller, Abrams, Bates, Niaura, Sweanor truthfully inform FDA’s Scott Gottlieb that flavorings in vapor and smokefree tobacco products are important for helping smokers switch, warn him about biased anti-flavoring and anti-vaping propaganda issued repeatedly by Obama’s DHHS (to dupe the public and to lobby for FDA Deeming Rule).

Clive Bates: Regulating e-flavors – is the US regulator more likely to do harm than good and how would it know?

Carl Phillips: FDA previews war on flavors

Carl Phillips: Will FDA ban all non tobacco vapor flavors

FDA launches ANPRM pertaining to e-liquid flavoring

FDA abstract proposes imposing a federal rule (not an information gathering ANPRM) for ENDS (i.e. vapor products) battery standard that could ban many/most/all vapor batteries.

FDA abstract proposes imposing a federal rule (not an information gathering ANPRM) for “tobacco manufacturing practice (TPMP) requirements for manufacturers of finished and bulk tobacco products” that could ban many/most/all tobacco products (including vapor products).

FDA proposes imposing a federal rule (not an information gathering ANPRM) to “establish the format and content of” Substantial Equivalence reports for tobacco products (including vapor) https://www.reginfo.gov/public/do/eAgendaViewRule?pubId=201710&RIN=0910-AH89

Note that FDA has already issued 3 Guidances for SE tobacco product reports, most recently at

FDA ANPRM abstract seeks info about FDA’s absurd policy proposal to sharply reduce nicotine in combustible tobacco products to purportedly reduce their “addictiveness”, but fails to admit its proposed policy would increase harm for smokers, create black markets for lower priced untaxed cigarettes, and sharply reduce tobacco tax revenue and government programs they fund.

FDA announces plan to issue Advanced Notices of Proposed Rule Making (ANPRM) for restricting nicotine levels in combustible tobacco products, for banning flavorings in tobacco and vapor products, and for inquiring about potential premium cigar regulations

FDA accepts for scientific review a Modified Risk Tobacco Product (MRTP) application from Reynolds (which was recently bought by BAT) for Camel Snus to truthfully claim that cigarette smokers who completely switch to Camel Snus greatly reduce their risks of lung cancer, oral cancer, respiratory disease, and heart disease; 180 day public comment period.

Potential Tobacco Product Manufacturing Practices for Electronic Nicotine Delivery Systems

Carl Phillips: When quitting smoking, does ‘every try count’?

FDA Deeming Rule

NJOY and other vapor companies submit Citizens Petition to FDA urging agency to formally acknowledge that the TCA’s preemption clause preempts states from mandating warning labels that differ from the vapor product warning labels mandated by FDA’s Deeming Regulation
(regarding vapor product warning labels that are mandated in CA, OR and IN).

Economist editorial: How to regulate lower-risk smoking products (editorial correctly criticizes vapor sales bans, but then endorses FDA’s ongoing and forthcoming vapor product sales bans)

“It is perverse to ban a less harmful product like an e-cigarette from a market that allows the more dangerous version to be sold on every street.”

PMI study finds IQOS emits exponentially fewer harmful and potentially harmful constituents (HPHC) than a cigarette

Anti-THR activists claim TV show sharply increased IQOS sales in Japan, demonize lower risk alternative to cigarettes, fail to acknowledge huge decline in cigarette sales and smoking

Anti-THR reporters at Reuters allege scientific misconduct by PMI on IQOS, demounce PMI for marketing a lower risk alternative to cigarette smokers and for lobbying to legalize its sales.

Note those same Reuters reporters defended WHO lobbying to ban vapor and smokeless tobacco

Also, coauthor of Reuters articles Duff Wilson wrote many NY Times articles in 2009-2011 that protected cigarettes by demonizing smokeless tobacco, snus, dissolvables and e-cigarettes.

Fojtik/Rodu: US, FDA can learn from Japan how to reduce smoking (advocates FDA approval of PMI’s IQOS, but remains silent about FDA’s ongoing and forthcoming vapor product sales bans)

CDC’s Brian King et al defend the research misconduct in the 2016 SG Report that demonized vaping (and that excluded all scientific evidence finding that vaping has helped millions of smokers quit smoking, has sharply reduced youth smoking, and has improved public health). https://academic.oup.com/ntr/advance-article-abstract/doi/10.1093/ntr/ntx266/4774596

Trump’s CDC refuses to admit that vaping has helped smokers quit smoking, keeps hawking ineffective and less-than-safe FDA approved drugs as only effective ways to quit smoking https://www.cdc.gov/features/smokingcessation/

THR Business

Wells Fargo’s Bonnie Herzog projects $5.1 Billion of vapor products will be sold in the US in 2018 (up from $4.4 Billion in 2017), including $3.5 Billion of Premium/Open Vaporizers and E-Liquid (up from $3 Billion in 2017), and $1.6 Billion of cigalike e-cigs (up from $1.4 Billion in 2017).  Herzog cited Nielsen data that $322 Million of Juul were sold in 2017, that Juul captured a huge 26.6% of the cigalike e-cig market segment in the past 4 weeks, while market shares for BAT/Reynolds’ Vuse, Altria’s Mark Ten, Fontem’s Blu, JTI’s Logic and NJOY all declined. https://www.e-cigarette-forum.com/threads/herzog-projects-5-1-billion-in-us-vapor-sales-in-2018-up-from-4-4-billion-in-2017.846087/

Steve Birr inaccurately claims DE’s new $.05/ml tax on e-liquid is “significantly less” than the 30% wholesale tax proposed by Gov. John Charney (as a $.05/ml tax on a 60ml bottle wholesaling for $6 is $3, but is just $1.80 with a 30% tax rate), fails to reveal that Reynolds lobbied DE legislators to change the 30% proposal to $.05/ml e-liquid tax to reduce vapor taxes for Vuse and other cigalike e-cigs and increase taxes on e-liquid companies and DE vape shops. http://dailyvaper.com/2018/01/02/vapers-brace-for-a-new-tax-treating-harm-reduction-devices-as-cigarettes/

George Will correctly criticizes ineffective anti-cigarette ads mandated by federal court, but wrongly condemns cigarette taxes and lawsuit settlements, repeats dubious and reprehensible claim that cigarette diseases, disabilities and early deaths benefit taxpayers, while failing to acknowledge smoking now imposes $200 Billlion in healthcare costs annually in the US (i.e. $15/pack, including $11/pack paid by taxpayers) and even higher costs for lost productivity. http://www.sltrib.com/opinion/commentary/2017/12/28/george-f-will-we-dont-need-government-to-remind-us-that-smoking-kills/

Junk Science, Propaganda and Lies

Philip Morris International Falsely Claims “We’re Trying to Give Up Cigarettes”

PMI runs full page ads absurdly claiming “Our New Year’s Resolution We’re Trying to Give Up Cigarettes” in the UK after the cigarette giant spent Billions of dollars this century lobbying US Congress, FDA and the public (in collusion with GSK’s Mitch Zeller, RWJF financed CTFK, ACS, AHA, ALA, AAP, AMA, left wing Congressional Democrats and news media) to enact the 2009 TCA and impose the 2016 Deeming Rule, which have protected PM’s Marlboro cigarette and Big Pharma’s NRT markets by banning sales of ALL new low risk smokefree tobacco products on 2/15/2007, banning truthful claims that smokefree products are less harmful than cigarettes, requiring false fear mongering warnings on all smokefree products, and allowing exemptions (to create a monopoly/cartel) for just several of the several thousand manufacturers to market just several of the several million smokefree products (at a cost of $20+ million for each PMTA and MRTP), which only PMI and a few other large tobacco companies can afford.   http://www.businessinsider.com/philip-morris-international-give-up-cigarettes-advert-2018-1

WHO’s Tedros deceitfully conflates all low risk smokefree tobacco products with cigarettes, and admits WHO is far more interested in fighting tobacco companies (which has enriched tobacco companies) than reducing cigarette diseases, disabilities, healthcare costs and deaths.fhttp://www.who.int/mediacentre/commentaries/big-tobacco-smokescreen/en/

“Governments and health organizations like ours are at war with the tobacco industry, and we will continue fighting until we beat Big Tobacco.”

JAMA Pediatrics publishes yet another DHHS funded junk gateway study by THR opponents at UCSF to lobby for flavored vapor and OTP sales bans to adults; among 9,909 never cigarette smoking teens, study found just 11 ever users of an e-cig, 3 ever users of smokeless tobacco, 8 ever users of hookah, and 7 ever users of a cigar who had smoked a cigarette a year later; but UCSF authors and press office falsely claim study found vapor and OTP use precedes cigarette smoking.  Authors inappropriately excluded all baseline “ever cigarette smokers” from their study (because they were exponentially more likely than all OTP users combined to have smoked a cigarette a year later).  News media repeat false UCSF claims without any fact checking. https://www.ucsf.edu/news/2017/12/409501/youth-using-alternative-tobacco-products-are-more-likely-smoke-1-year-later

Brad Rodu further reveals that 80% of the 219 teen cigarette smokers (in UCSF junk study above) had never used any tobacco or vapor product prior to baseline, and that UCSF authors and press release failed to reveal that critically important finding. https://rodutobaccotruth.blogspot.com/2018/01/tobacco-gateway-report-omits-important.html

‘Junk science’?  Studies behind Obama regulation under fire http://www.foxnews.com/politics/2017/12/26/junk-science-studies-behind-obama-regulations-under-fire.html

“The CDC’s use of surveys to undermine the harm reduction and smoking cessation viability of e-cigarettes is junk science,” said Hank Campbell at ACSH.

DHHS funded vaping prohibitionists find air quality at a vaping convention with >600 people was within indoor PM10 particle air quality standards over 8 hours; but confuse/scare readers by inappropriately comparing their indoor data to far more restrictive 24 hour outdoor air quality standards, by demonizing vaping, and by urging FDA to ban vaping in all workplaces (even though FDA has no legal authority to do so).

DHHS funded prohibitionists at UNC conduct biased push poll of mostly naïve non smoking US adults to advocate more disastrous FDA bans (beyond FDA’s Deeming Rule that bans the sale of >99.99% of vapor products to adults), than claim many in US support banning so-called candy flavored e-cigs and cigars, reducing nicotine in cigarettes, and banning menthol from cigarettes.

DHHS funded vapor prohibitionists and propagandists at Yale find past 30 day adult e-cig users vaped more often than past 30 day teen e-cig users, were more likely to have vaped nicotine, prefered a greater number of e-cig flavorings, and preferred somewhat different flavorings (with slightly more adults preferring candy/dessert flavors); but authors (who have repeatedly urged FDA to ban sales of vapor products to adults) tout irrelevant data, demonize vaping of flavors.

NIDA funded anti vaping propagandists at Univ of Michigan (who still haven’t released 2015 and 2016 MTF data comparing teen e-cig use among smokers, exsmokers and never smokers after their 2014 MTF found smokers and exsmokers were both far more likely to use e-cigs in past 30 days than were never smokers) compare far less accurate and reliable 2015 and 2016 MTF data on purported “reasons for vaping” to claim that only 7.3% of teens vaped to replace smoking.  Full text details of taxpayer financed study is buried behind a paywall. https://www.ncbi.nlm.nih.gov/pubmed/29273302

FDA funded anti vaping activists find smokers who seek information about vaping are more likely to begin vaping, so authors recommend FDA further discourage smokers from vaping. http://www.tandfonline.com/doi/full/10.1080/10410236.2017.1407229

Chinese vaping opponents find many Hong Kong teens know truthful information about vaping (despite Hong Kong’s decade old vapor sales ban), advocate more lying to teens about vaping.  http://www.mdpi.com/1660-4601/15/1/54/htm

Chinese anti-vaping junk scientists grossly misrepresenting the scientific and empirical evidence on vaping, repeat the many of the false fear mongering claims about vaping that have been made by DHHS funded vapor and vaping prohibitionists, universities and health agencies. https://www.ncbi.nlm.nih.gov/pubmed/29304018

Steve Birr: ‘Science Guy’ Bill Nye mocks vapers, says ‘cigarettes don’t kill fast enough’

USC anti vaping activist claims accurate statements about vaping are “fake news”

NY Times reporter hypes anti vaping propaganda at MTF press conference, ignores findings that teen smoking rate has plummeted since 2010 as millions of smokers have switched to vaping https://www.nytimes.com/2017/12/14/health/teen-drug-smoking.html?_r=0

Welcome Back, Bill! 🙂

2018 Federal Spending Bill

American E-Liquid Manufacturing Standards Association (AEMSA) sends letter urging Congressional leaders to exclude Cole-Bishop amendment from 2018 federal spending bill (because it requires FDA to issue a Final Rule for “a product standard for vapor products” “to include but not limited to” “characterizing flavors” and “batteries” by January 2021, which could ban virtually all vapor sales more than a year before the Deeming Rule would in August 2022).

29 Republicans in Congress urge White House OMB Director Mick Mulvaney to support exempting premium cigars from FDA’s Deeming Reg/Ban in 2018 federal spending bill

Evolution of Cole-Bishop language

Introduced in May 2015, the Cole bill (HR 2058) only changed TCA’s 2007 predicate date for Deemed tobacco products (including vapor products)

Introduced in 2016, the Cole-Bishop amendment to the House spending bill would have changed the 2007 predicate date, would have required FDA to propose a standard for vapor product batteries within 12 months and issue a Final Rule within 24 months after issuance of Deeming Rule, and would have restricted print advertising to publications primarily read by adults.

Introduced in 2017, the Cole-Bishop bill (HR 1136) and the Cole-Bishop amendment to the House spending bill would change the 2007 predicate date, but would also require FDA to issue a Final Rule for “a product standard for vapor products” “to include but not limited to” “characterizing flavors” and “batteries” by January 2021, as well as restrict print advertising to publications primarily read by adults.

FDA Deeming Rule

HK Law’s Azim Chowdhury: FDA’s new tobacco strategy: What does it mean for your vape business? (from July)

AEMSA urges FDA to modify the Deeming Rule to once again allow vapor manufacturers to effectively and lawfully market lifesaving vapor products to adult smokers

AEMSA expands membership to include all segments of the electronic vapor industry (i.e. manufacturers, distributors and retailers), to develop sector-specific standards to ensure good manufacturing standards, ingredients quality control, and consumer safety

FDA announces new campaign to purportedly discourage youth from vaping that could encourage more youth to vape (as telling teens to not vape just encourages them to vape).

News media repeat FDA’s hype about program to purportedly reduce teen vaping

Bloomberg/DHHS funded Johns Hopkins invites Scott Gottlieb, Mitch Zeller, Josh Sharfstein (who unlawfully banned vapor products in 2009), Joanna Cohen, Dorothy Hatsukami and Ken Warner to promote/discuss FDA Deeming Rule and nicotine reduction plan for cigarettes, FDA’s  Gottlieb unveils new Real Cost ad that further demonizes nicotine and vapor products, and that could encourage more nonsmoking teens to vape.

Carl Phillips: FDA releases new nonsensical anti vaping ad

FDA issues new infographic that deceives readers to inaccurately believe that:

– very low risk e-cigarettes and smokeless tobacco, and lower risk cigars, pipe tobacco and hookah are just as harmful as cigarettes,

– experimental and occasional use of any vapor or tobacco product is as harmful as daily cigarette smoking (by citing only “past 30 day” use data), and that

– all e-cigarettes and vapor products are tobacco products.

Brian Fojtik: Stop lying to smokers about safer alternatives

FDA issues report citing unsubstantiated criticisms it solicited and received about e-cigs and tobacco products (after Obama’s FDA and DHHS deceived the public about e-cigs).

Carl Phillips: FDA’s motive for releasing vapor product reports raises questions

FDA’s Scott Gottlieb, Mitch Zeller and Janet Woodcock announce another effort to promote and market even more ineffective NRT drugs to smokers; public hearing set for 1/26/2018.

FDA and DHHS promote yet another program to increase sales of Big Pharma’s ineffective and less than safe tobacco cessation drugs, and to deceive Americans to inaccurately believe FDA approved drugs are the only effective ways to quit smoking.

Jonathan Adler: Why FDA Regulations limiting e-cigarette marketing may cost lives and violate the constitution

US DOJ Lawsuit against Cigarette Companies

Cigarette companies air advertisements mandated by US Court (pursuant to DOJ lawsuit) that falsely claim nicotine is addictive. In fact, cigarette smoking is addictive, not nicotine. http://abcnews.go.com/Health/wireStory/big-tobaccos-anti-smoking-ads-begin-decade-delay-51292806

New CDC webpage on e-cigarettes contains dozens of false and misleading fear mongering claims about vaping, cites biased US PHS report hawking Big Pharma’s nicotine and falsely claiming evidence is “insufficient” to recommend vaping for smoking cessation; but finally admits vaping is less harmful than smoking cigarettes and that vaping “may help non-pregnant adult smokers” but only “if used as a complete substitution for all cigarettes and other smoked tobacco products.”

Alex Berezow: On e-cigarettes, CDC should learn from UK’s NHS

CDC reports 2014-2016 NHIS data for tobacco use among working adults; deceptively insinuates that all types of tobacco products (including vapor) are as harmful as cigarettes, that using multiple tobacco products is more harmful than using one type (including cigarettes), and that “some day” use is as harmful as “every day” use (by combining them into the same group inaccurately called “current users”); calls for “tobacco-free” policies for all workplaces and public places, and other policies to prevent smokers from switching to smokefree alternatives.

Carl Phillips critiques CDC NHIS data on e-cigarette use by occupation, races, etc.

CDC issues chart/list of state laws that regulate sales, taxation and use of vapor products

US THR Surveillance

NIDA funded 2017 Monitoring the Future (MTF) survey finds:
–        New record low lifetime, past month and daily cigarette smoking rates among US teens,
–        Past 30 day cigarette use fell to 1.9% among 8th graders, 5.0% among 10th graders, 9.7% among 12th graders,
–        Daily cigarette use fell to .6% among 8th graders, 2.2% among 10th graders, and 4.2% among 12th graders,
–        3.5% of 8th graders, 8.2% of 10th graders, and 11.0% of 12th graders vaped nicotine in past 30 days,
–        Among the 27.8% of 12th graders who vaped in the past year and were asked what they inhaled the last time they vaped, 51.8% said “just flavoring”, 32.8% said “nicotine” and 11.1% said “marijuana” or “hash oil”.

CDC issues select 2016 NHIS vaping data, finds:
– 1.2% of US adults (2.97M) were “daily” vapers in 2016;
– 3.2% of US adults (7.93M) were “current” e-cigarette users (i.e. every day or some days), down from 3.4% in 2015, and down from 3.7% in 2014;
– E-cigarettes were used “every day or some days“ by 4.5% of 18-24 year olds (1.41M), 4.2% of 25-44 year olds (3.56M), 2.9% of 45-64 year olds (2.44M), 1.0% of 64+ year olds (.48M); and
– 15.4% of US adults (38.16M) had ever used an e-cigarette.

Brad Rodu: 2016 CDC data shows e-cigarette use declines again, finds
– 7.8 million currently used e-cigs,
– 3.9% (4.5 million) of men currently used e-cigs, and 2.6% (3.3 million) women did so,
– former smokers accounted for 34% of “current” e-cig users, up from 30% in 2015, and from 22% in 2014.

Clive Bates: Trends in tobacco and nicotine use in the United States (excellent charts showing data from NYTS, MTF and NHIS surveys).

Brad Rodu: New Vaping Insights Based on FDA’s PATH Survey 2013-14

Rodu/Plarphanswat analyze FDA 2013-14 PATH adult survey data, find:
– 5.6% (12.9M) of US adults were either current e-cigarette users or triers, including 2.4% (5.5M) e-cig users and 3.2% (7.4M) e-cig triers,
– 1.0% (2.3M) of US adults vaped daily, 1.4% (3.2M) vaped on some days, 3.2% (7.4M) were current e-cigarette triers,
– 0.3% (.7M) of US adults were both former cigarette smokers and former e-cig users, accounting for 26.9% of former e-cig users, and indicating that many smokers who quit smoking by switching to vaping also subsequently quit vaping,
– 45.7% (1.1M) of daily vapers were former smokers, 27.7% were daily smokers, 19.0% were some day smokers, 3.8% were current cigarette triers, 3.3% were former cigarette triers, 0.5% were never cigarette smokers,
– 61.5% (2.0M) of some day e-cigarette users were daily smokers, 13.0% were some day smokers, 9.5% were former smokers, 9.3% were current cigarette triers, 5.0% were former cigarette triers, 1.8% were never cigarette smokers,
– 62.3% of current e-cigarette triers were daily smokers, 13.2% were some day smokers, 6.4% were former smokers, 10.7% were current cigarette triers, 5.6% were former cigarette triers, 1.8% were never cigarette smokers.

Brad Rodu: More vaper insights from FDA PATH 2013-14;

Rodu/Plarphanswat analyze FDA 2013-14 PATH adult survey data, find top reasons for vaping:

  1. “less harmful to me” (94%),

2013/14 FDA PATH adult survey data finds use of e-cigarettes among smokers and former smokers was significantly higher than use of FDA approved NRT products, use of e-cigarettes was only the smoking cessation method other than unassisted quit attempts with higher odds of being a former smoker.

Brad Rodu – Population Level Proof: E-cigarettes are popular and successful quit-smoking aids

Study of 15,532 recent cigarette smokers (since 2010, which included 75% current smokers and 25% former smokers) from 2014/15 NHIS data finds:
– 52% of daily adult vapers in the US have quit smoking since 2010, compared to 28% who never vaped, and to 12% of some day vapers;
– daily vapers were 3.18 times more likely to quit smoking since 2010 than never vapers;
– daily vapers accounted for 10.7% of former smokers, but just 3.3% of current smokers.

2014/15 CPS-TUS survey of US adults found regular vaping (i.e. 20 or more of past 30 days) was reported by 12.7% of former smokers (<1 year), by 7.4% of former smokers (1-3 years), by 3.6% of current smokers, and by just .1% of never smokers; found 7.7% of adults ever used an e-cig, 2.1% currently used e-cigs (i.e. at least once in past 30 days), and .9% regularly vaped.

Study of CDC NATS data finds the number of US adults who switched from cigarettes to vapor products increased 100% from 2012/2013 to 2013/2014

Study by former CDC OSH director Michael Eriksen et al finds nicotine was vaped by 81% of US adult smokers who vape, but just by 37% of adult non smokers who vape.

Although many surveys have found that many vapers do NOT vape nicotine, the US DHHS still falsely classifies all vapor products as “tobacco products” and everyone who vapes (including those who vape just flavors, CBD and/or THC) as “tobacco users”.

Canadian THR Surveillance

2016 Canada survey confirms vaping has NOT renormalized smoking, finds:
– cigarette smoking by youth (12-17) declined to 3.6% (from 4.1% in 2015),
– smoking by 12+ year olds declined to 16.9% (from 17.7% in 2015, and 20.9% in 2012),
– 3.7 million Canadians smoke daily (down from 3.8 million in 2015, and 4.5 million in 2012)

UK THR Surveillance

Young People’s Use of E-Cigarettes across the United Kingdom: Findings from Five Surveys 2015-2017 finds:
– Just 1%-3% of 11-16 year olds in the UK regularly use e-cigarettes at least weekly,
– Among regular cigarette smokers, 7%-38% regularly use e-cigarettes,
– Among never smokers, 0.1%-0.5% regularly use e-cigarettes,

French THR Surveillance

Survey of French university students finds:
– 12% of former smokers, 5% of current smokers, and 0.3% of never smokers were current e-cig users,
– 9% of former smokers and 2% of current smokers were daily vapers,
– just 3.3% of current and former smokers used an e-cig prior to smoking cigarettes,
– although 13.2% of never smokers ever used an e-cig, just 0.3% currently used e-cigs,

Carl Phillips – Science Lesson: Clinical trials are a terrible way to assess vaping

NCI funded study finds vast majority of vaping news in the US in 2015 was anti-vaping propaganda about youth (most of which was generated by Obama’s DHHS to lobby for FDA’s vapor sales ban to adults).

Study finds particles in vapor aerosol emissions pose excess lifetime cancer risk 5 orders of magnitude lower than those in cigarette smoke.

DHHS funded Primack et al and Univ of Pittsburgh issue another junk e-cig study and press release falsely claiming their study found e-cigs are gateways to cigarettes; Godshall criticizes study’s inappropriate reliance on “ever use” as a “witch hunt to demonize vaping” in news)

Back in 2015, Primack et al issued a similar “ever use” study and press release that falsely claimed e-cigs are a gateway to cigarette smoking, with similar criticisms by Godshall and Rodu.

Carl Phillips: Pediatric journal straight up lies about e-cigarettes

Polosa/Russell/Nitzkin/Farsalinos analysis of US Surgeon General’s report on e-cigarette use among youth and young adults reveals it contained more fiction than facts

Yet another article and editorial in Pediatrics (issued by longtime vapor prohibitionists at AAP) claims e-cig use by teens leads to cigarette smoking, but study fails to account for (or even mention) dual users (i.e. those who used an e-cig and a cigarette in past month);

Lazy news media fails to acknowledge errors in the study, and instead repeat fear mongering claims of FDA/NIDA funded anti-vaping authors, while NPR blames JUUL.

DHHS funded Glantz keeps falsely claiming vaping is a gateway to cigarette smoking, denies all evidence that vaping has helped millions of smokers quit smoking.

Smokeless Tobacco Junk Science, Propaganda and Lies

Rodu: Government funded researchers continue to misrepresent smokeless tobacco cancer risks

Lynn Kozlowski (at FDLI conference) once again urges US DHHS to stop unethically deceiving Americans about the very low risks of smokeless tobacco.

THR opponents at FDA/NIH find (but fail to mention in abstract) that just 11% of American adults accurately know that smokeless tobacco is less harmful than cigarettes, comments by Rodu, Sweanor and Bates criticize FDA/NIH authors for refusing to acknowledge that smokeless tobacco products are far less harmful than cigarettes.

Breaking News

FDA Commissioner Scott Gottlieb delays FDA’s vapor PMTA application deadline and vapor prohibition date from November 8, 2018 until August 8, 2022, vaguely endorses THR, calls for FDA to develop a new comprehensive plan for tobacco, nicotine, vapor and flavor product regulation

Scott Gottlieb’s special announcement on tobacco/nicotine/vapor policy is at

Gottlieb also said FDA CTP intends to:
– maintain Deeming Rule’s sales ban on all new vapor products since August 8, 2016,
– maintain Deeming Rule’s ban on truthful health claims by vapor manufacturers,
– reevaluate Deeming Rule’s policies on vapor products, cigars and OTP,
– promulgate regulations and final guidances for PMTA, MRTP and SE applications,
– promulgate rules on “kid-appealing” flavors in tobacco/vapor products (after FDA and its funding recipients falsely claimed, since 2009, that flavorings are marketed to youth),
– promulgate more rules and standards for ENDS (vapor products), and
– mandate low nicotine cigarettes (which would increase harms for many/most smokers, and would create an enormous black market for cigarettes).

FY 2018 House Agriculture Appropriations bill includes Cole/Bishop language

House Appropriations Committee Markup session 7/12/17

FY 2018 House Agriculture Appropriations bill is at (see Section 753)

US Rep. Nita Lowey (D-NY) offers amendment (during US House Appropriations Cmte markup session) to keep Obama’s FDA Deeming Rule (that bans the sale of >99.99% of vapor product sales to adult smokers and vapers on November 8, 2018), Reps. Lowey, Rosa DeLauro (D-CT), Jose Serrano (D-NY), Lucille Roybal-Ballard (D-NY) and Debbie Wasserman-Shultz (D-FL) repeat false fear mongering claims about vaping and FDA’s vapor Deeming ban; Reps. Robert Aderholt (R-AL), Sanford Bishop (D-GA), Tom Cole (R-OK), Andy Harris (R-MD) speak against Lowey’s amendment and tell truth about vaping; Committee rejects Lowey amendment 31-21, then approves bill.

Big Pharma shill CTFK and its partners (ACS, AHA, ALA, AAP, etc.) lie to US House Appropriations Committee about FDA’s Deeming Regulation (that bans sales of >99.99% of lifesaving vapor products, and many/most cigars and pipe tobacco products on 11/8/2018), the Cole/Bishop language in the House Agriculture Appropriations bill, and about lifesaving vapor products, low risk cigars, flavorings and children

Mike Siegel: Campaign for Tobacco Free Kids is deliberately lying to the public

Big Pharma funded ALA’s Harold Wimmer keeps lying about Obama’s FDA Deeming Regulation, and about the Cole/Bishop language in the House Appropriations Bill

ABC News: House panel seeks to block FDA ‘vaping’ rules (in fact, the Cole/Bishop amendment would just move the TCA’s 2/15/07 grandfather date to 8/8/16 for newly deemed tobacco/vapor products, but would implement all other FDA Deeming Rules)

AP headline falsely claims Cole/Bishop amendment would exempt e-cigs from FDA regs

Former CDC Directors Tom Frieden and Bill Frist (in op/ed opposing US House Appropriations bill’s budget for CDC) falsely claim it “would result in at least 15,000 additional, avoidable deaths per year” from tobacco and “would be public health malpractice”. But Tom Frieden’s fear mongering lies about lifesaving vapor products, his lobbying for FDA’s vapor Deeming ban, and his/CDC’s funding of state/local health depts to unlawfully lobby (with US funds) to ban vaping in workplaces was the worst public health malpractice in US history.

More Junk Science, Propaganda and Lies

Joel Nitzkin exposes the deeply flawed research methods (er misconduct) used in DHHS funded junk studies claiming e-cigarette experimentation leads to cigarette smoking among teens and young adults (and the so-called meta study by Soneji et al of many junk studies): Soneji responds by misrepresenting Nitzkin’s criticisms, by defending the many deeply flawed research methods, and by repeating false claims about vaping.

Joel Nitzkin also sent the following letter to JAMA Pediatrics, which refused to publish it, documenting the journal editor’s contempt for truth, science and public health http://jamanetwork.com/journals/jamapediatrics/fullarticle/2634377

Reuters headline and article grossly misrepresents the WHO FCTC COP meeting in Delhi (where WHO banned public health advocates and the news media, and where vapor prohibition laws, plain packaging tobacco laws, and censoring tobacco companies from public policy processes were all advocated), demonizes 2014 PMI power point that opposed vapor product bans (which protect cigarettes), taxing all tobacco products the same rate as cigarettes (which discourage smokers from switching to low risk products), plain packaging tobacco laws (that didn’t reduce cigarette smoking in Australia), point-of-sale tobacco display bans (that prevent customers from seeing products), excessive health warning sizes (that aren’t necessary) and ingredient bans (e.g. flavors, nicotine).

Vaping prohibitionist Michael Bloomberg funded Bloomberg American Health Initiative Director Josh Sharfstein (who, as FDA Deputy Commissioner, unlawfully banned lifesaving vapor products and lied about them in 2009/10) hires Michelle Spencer as Associate Director, touts new program that includes reducing drug addictions.

Washington Post editorial falsely attributes decline in youth smoking to Obama DHHS’ abstinence-only anti-vaping policies and propaganda

FDA/NIH/Legacy/CA DPH funded vapor prohibitionist Stan Glantz claims best way to continue reducing smoking is by further increasing cigarette taxes, further extending smoking bans and advertising bans, and banning smoking in movies and other media (but not keeping lifesaving vapor products legal for adult smokers and vapers)

FDA Deeming Regulation

US House Committee on Appropriations Subcommittee on Agriculture approves FY18 Agriculture Appropriations Bill that includes altered Cole/Bishop language (that would require FDA to propose standards for “characterizing flavors” within 21 months, which allows FDA to ban the vast majority of flavors in vapor products), and that exempts large premium cigars from FDA’s Deeming Rule.

More Junk Science, Propaganda and Lies

DHHS funded vapor prohibitionists conduct, JAMA Pediatrics publishes, meta analysis of 9 intentionally biased junk studies on vaping and smoking experimentation that excluded data on smokers who switched to vaping to falsely claim (yet again) that vaping leads to cigarette smoking (despite huge decline in youth and young adult smoking rates since 2010, despite new record low smoking rates each year, despite decline in cigarette consumption, despite surveys finding millions have quit smoking by switching to vaping, and despite rapid growth of vapor product sales and vape shops).

FDA/NCI funded vaping opponents find ever vapers reported significantly lower trust in governmental agencies than never vapers, find trust in vapor companies was negatively associated with perceived addictiveness of vapor products, then unethically recommend more lies and disinformation to demonize lifesaving vapor products: “future campaigns should incorporate messaging to discredit industry sources of information and utilize non-governmental sources to effectively influence e-cigarette attitudes.”

US THR Surveillance and Deception

CDC releases 2016 NYTS data, finds decline in past 30 day youth smoking and vaping; but Obama leftovers at CDC continue to deceitfully conflate very low risk vapor and smokeless tobacco products (and low risk cigars and pipes) with highly addictive and deadly cigarettes, continue to fraudulently classify all vapor products as “tobacco products” and all vapers as “tobacco users” (after NIDA’s 2015 MTF survey found that most teens who vaped did NOT vape nicotine).

NYTS found

“Past 30 day” cigarette smoking by high school students (9th-12th grade)
2011 – 15.8%
2012 – 14.0%
2013 – 12.7%

49% decline from 2011 to 2016

“Past 30 day” e-cig use by high school students (9th–12th grade)
2011 – 1.5%
2012 – 2.8%
2013 – 4.5%
2014 – 13.4%
2015 – 16.0%
2016 – 11.3%

“Past 30 day” cigarette smoking by middle school students (6th–8th grade)
2011 – 4.3%

Big Pharma funded vapor prohibitionists at CTFK congratulate themselves (and CDC’s anti vaping propaganda and lobbying campaigns) for decline in youth cigarette smoking

Teen tobacco use hits a record low, with a sharp drop in e-cigarettes (but Washington Post article touts more false spin by anti THR vapor prohibitionists at CDC, Legacy lies initiative and Big Pharma shill CFK)

HealthDay article spins findings on 2016 CDC NYTS data by only interviewing vapor/vaping prohibitionists (CDC’s Brian King and CTFK’s Matt Myers)

AP article cites US teen vaping decline, but falsely attributes decline to vapor sales bans to minors and government anti-vaping propaganda, interviews three vapor/vaping prohibitionists/propagandists, doesn’t interview any THR advocate or objective person.

NPR hypes CDC’s dubious claim that teen vaping declined for the first time (as NIDA’s MTF survey found teen vaping peaked in 2014, and dropped in 2015 and again in 2016), repeats spin by vapor prohibitionists and propagandists Brian King and Robin Koval

Reuters article repeats CDC’s deceitful conflation of very low risk vaping with highly addictive and deadly cigarette smoking, but quotes Mike Siegel pointing out that CDC’s survey proved that vaping is not a gateway to cigarette smoking (which Obama’s DHHS, its funding recipients, and Big Pharma shills have falsely claimed since 2009).

CDC study finds most current cigarette smokers in 8th & 11th grade in Oregon smoked cigarettes as their first tobacco product (54% & 58%), and that far fewer current smokers (22% & 15%) reported vaping first; But authors deceitfully conflate vaping with cigarette smoking, manipulate data to falsely classify all vapor as “tobacco products”, falsely label everyone who ever vaped as a “tobacco user” (despite NIDA’s 2015 MTF survey finding that most teen vapers don’t vape nicotine), and falsely insinuate vaping has addicted many nonsmoking youth and has been a gateway to cigarettes to lobby for vaping bans, vapor taxes and FDA’s vapor Deeming Ban.

FDA Commissioner Scott Gottlieb Repeats Anti-THR Propaganda

FDA Commissioner Scott Gottlieb’s statement on CDC 2016 NYTS youth smoking and vaping data repeats abstinence-only anti-THR propaganda by Obama’s DHHS, deceptively conflates all “tobacco use” (and vaping) with deadly cigarette smoking.

– acknowledge that vapor products are far lower risk than cigarettes,
– delay vapor prohibition day (i.e. PMTA deadlines) by at least 4 more years,
– move to a reasonable and responsible “standards based” vapor product regulations,
– develop regulations that encourage low risk tobacco/nicotine product innovation,

DHHS financed 22nd Century lobbies governments to ban all cigarettes (except 22nd Century’s government financed very low nicotine cigarettes that smokers won’t buy) by touting a heavily biased push poll claiming 74% of adults believe “government should mandate that all cigarettes have very low, non-addictive levels of nicotine.”

More Junk Science, Propaganda and Lies

ALA’s Dona Wininsky deceitfully claims vaping is as at least as harmful as smoking cigarettes, fails to admit youth smoking in WI dropped 24% (from 10.7% in 2014 to 8.1% in 2016) as past 30 day vaping (mostly experimental) increased; Godshall comments

Mike Siegel: American Lung Association in Wisconsin is lying about health effects of smoking

UCSD study of 18-24 year old non daily smokers in California who also frequently vaped (i.e. just 1%-2% of 18-24 year olds) finds that some increased their cigarette consumption after the CA Health Dept began its massive campaign lying about vaping (to lobby for the CA workplace vaping ban), but authors failed to mention the CA Health Dept’s anti vaping campaign so they could falsely insinuate that vaping leads to increased smoking.

FDA/NIH funded Stan Glantz hypes findings of UCSD study on 1%-2% of CA smokers ages 18-24 to falsely claim (yet again) that vaping is a gateway to cigarette smoking, fails to disclose that study began the same month CA DPH began falsely claiming vaping was as harmful as cigarette smoking to lobby CA legislators to ban vaping in all workplaces.

Reuters article repeats false claim by UCSD anti vaping activists and DHHS funded Stan Glantz that some young nondaily smokers who vape smoked more cigarettes over time (but failed to mention study began the same month CA DPH began lying about vaping)

FDA/NIH funded Stan Glantz et al grossly exaggerate risks of vaping and of marijuana use in public comments to CA DPH opposing proposed marijuana regulation.

NIH funded Univ of Connecticut and anti vaping activists falsely claim vaping may be as harmful as cigarette smoking based upon inapplicable DNA junk study using purportedly novel measurement tools, news media headlines hype false fear mongering claim

E-cigarettes ‘Potentially as Harmful as Tobacco Cigarettes’

Bryan Clark – E-cigarettes as harmful as their analog counterparts? Not so fast

Reuters headline/article repeats fear mongering lies by CDC’s Brian King (from May) that vapor aerosol harms vapers, nonvapers and children (despite no evidence) without any fact checking (due to CDC’s propaganda and press release).

DHHS funded Thomas Wills and James Sargent falsely claim vaping doesn’t reduce smoking, but their deceitful propaganda was thankfully buried behind a paywall.

For “No Smoking Month”, Philippines Health Dept. protects cigarettes by falsely claiming vaping emits 7,000 harmful chemicals, and poses the same risks as smoking http://news.abs-cbn.com/news/06/14/17/doh-frowns-on-use-of-vapes-e-cigarettes

After finding another record low youth smoking rate, Minnesota Health Dept reissues fraudulent health advisory conflating very low risk nicotine and vaping with deadly cigarette smoking to confuse and scare the public, and lobby for anti vaping laws; news media repeats MN Health Dept’s lies and propaganda without any fact checking.

Anti vaping activists tout more inapplicable cell studies to further confuse, scare and promote anti vaping laws

Reuters headline and article tout study authors’ intentionally deceptive claim that snus use is associated with increased asthma and nocturnal breathlessness, but GSU’s Lucy Popova is quoted truthfully claiming “snus is safer than smoking.”

Washington Post article touts deceitful spin by CDC, CTFK and Legacy, whose anti-THR policies and propaganda that have discouraged poor smokers from quitting;

William Wan: America’s new tobacco crisis: The rich stopped smoking, the poor didn’t

Snus Saves Lives: A study of snus and tobacco related mortality in the EU

The Snus Commission’s third report estimates deaths attributable to the EU snus banhttps://www.clivebates.com/documents/SnusCommissionJune2017.pdf

“In total and among men over the age of 30, 355,000 lives per year could have been saved if the other EU countries had matched Sweden’s tobacco-related mortality rate. Sweden clearly has the lowest tobacco- related mortality rate within the EU in relation to its population despite daily tobacco consumption among men being at the same level as other countries in Europe.” “In 24 of the EU’s 27 member states, the tobacco-related mortality rate is more than double that of Sweden, relative to their population size.”

San Diego State study finds vaping not an indoor air pollutant, finds leading causes of indoor air pollution (i.e. PM 2.5) in California homes are cigarette smoke, marijuana smoke, vacuuming/dusting/sweeping home in past week, frying food and burning incense/candles; “We observed no apparent difference in the weekly mean particle distribution between 43 homes reporting any electronic cigarette usage and those reporting none.”  See Tables 4 & 5

But indoor air pollution study abstract and San Diego State’s press release touting the study never mentioned the study’s key finding (i.e. vaping NOT an indoor air pollutant)

Study finds cigarette smokers who vape (dual users) were far more likely than exclusive smokers (25.9% vs 11.2%) to reduce cigarette consumption by 50+% after six months, and were far more likely (22.8% vs 10.9%) to make a quit attempt of at least 7 days, further documenting the health benefits of vaping by cigarette smokers (i.e. dual use).

But authors falsely claim “It remains unclear whether regular e-cigarette users are also more likely to stop smoking.”

BAT study finds no detectable difference between vapor produced by e-cigarette (Vype epen) and new heat not burn product (iFuse)

EU THR Surveillance

European Commission issues anti-THR Special Eurobarometer 458 Report: Attitudes of Europeans towards tobacco and e-cigarettes; 205 page EC report on 2017 survey finds:

Smoking in EU

– Sweden (7%) and UK (17%) have lowest smoking rates (due largely to THR products).

– Largest smoking declines since 2006 were in Sweden (from 18%) and UK (from 34%).

– Greece (37%), Bulgaria and France (36%), Croatia (35%) have highest smoking rates.

– While 25% of EU residents 15+ and 24% of Swedes 15+ use tobacco daily, 24% of EU residents 15+ smoke daily compared to 5% in Sweden (where snus has been legal).

– 91% of smokers in the EU smoke daily compared to just 52% in Sweden.

– 26% of EU residents 15+ smoke cigarettes, cigarillos, cigars or pipe, but 24% do daily.

– EU cigarette smokers consume an average of 13.7 cigarettes per day.

– Few EU residents 15+ smoke cigarillos (3%), cigars (2%) or pipes (1%), and just 1% smoke any of these products daily.

Smokeless Tobacco Use in EU

– Just 5% of EU residents 15+ ever used low risk smokeless tobacco compared to 50% in Sweden (due to the EU’s cigarette protecting snus ban that Sweden is exempted from).

– <1% of EU residents 15+ use low risk smokeless tobacco daily compared to 20% in Sweden, 2% in Finland and 1% in Denmark.

Vaping in EU

– 4% of exsmokers in the EU currently vape, including 14% in UK, 7% in Ireland, 6% in France and Belgium, 5% in Greece, but just 0% in Spain, Lithuania, Latvia, Slovakia and Luxemburg, and just 1% in Germany, Italy, Poland, Sweden, Portugal, Romania, Bulgaria, Slovenia, Estonia, Netherlands and Cyprus.

– 4% of smokers in the EU currently vape, including 8% in France & Belgium, 7% in Austria, Denmark & Luxumbourg, 6% in UK, Germany, Malta & Cyprus, but just  0% in Germany, Italy, Sweden, Hungary & Croatia, and 1% in Romania, Slovakia & Slovenia.

– Among current vapers in the EU, 67% vape daily, 20% vape weekly, 7% vape monthly.

– Among current vapers in the EU, 47% vape fruit flavors, 36% vape tobacco flavor, 22% vape menthol or mint flavors, 18% vape candy flavors, and 2% vape alcohol flavors.

– Among ever users of tobacco and e-cigarettes in the EU, just 1% used e-cigarettes first (disproving the Big Lie that e-cigs are gateways to cigarette smoking).

Smoking Cessation in EU

– Among exsmokers in the EU, 81% quit smoking without assistance, 7% quit with Big Pharma drugs, 6% quit by vaping, and 4% quit with medical advice or cessation service.

– Among EU smokers who have tried to quit, 66% tried to quit without assistance, 16% tried Big Pharma drugs, 15% tried e-cigarettes, 6% tried medical or cessation services.

Note the EC report authors asked biased questions about vaping and smokeless tobacco, and presented skewed findings (e.g. by using “ever use” data in the denominator) to demonize low risk vapor and smokeless tobacco, and to discredit them as cessation aids.

Australian Surveillance

Australian government survey finds insignificant decline in daily cigarette smoking (following its highly touted plain packaging law) compared to huge declines in the US and UK (where vapor products are legal and have helped millions quit smoking)

US THR Surveillance

CDC vapor prohibitionists find 45.2% of American adults know vaping causes little or no harm to children, but deceitfully claim CDC should continue deceiving the public about vaping and nicotine, and advocate more vaping bans and other policies to prevent more  smokers from switching to lifesaving vapor products

Press release hypes CDC’s junk study that deceives readers to believe 2nd hand vapor is harmful for children

CDC’a Brian King, Big Pharma funded ALA, left wing NPR and Baylor’s Harold Farber hype false fear mongering claims about 2nd hand vapor, deceitfully conflate smokefree vaping with deadly cigarette smoking

Mike Siegel: CDC bemoans fact that public has an accurate understanding of secondhand vaping risk

CDC’s Global Youth Tobacco Survey finds vastly different past month tobacco smoking rates among 13-15 year olds in 61 different countries (from 1.7% in Sri Lanka to 35% in Timor-Leste), median rate of 10.7%; Authors falsely claim “Tobacco use is the world’s leading cause of preventable morbidity and mortality, resulting in nearly 6 million deaths each year” (as daily cigarette smoking, not tobacco use, is the leading cause of disease and death, causing nearly 6 million deaths each year), document huge need for low risk smokefree alternatives, but tout WHO’s anti-THR MPOWER policies.

CDC and Big Pharma funded CTFK misrepresent findings of CDC’s international youth smoking survey to promote WHO FCTC & MPOWER, which oppose vaping, deceitfully conflate low risk smokeless tobacco with deadly cigarettes, lobby to tax low risk tobacco at same rate as cigarettes, lobby for taxpayer subsidization of ineffective Big Pharma cessation drugs and medicalization of cessation, and lobby for unconstitutional and ineffective advertising, promotion and sponsorship bans for ALL tobacco products.

More US DHHS Junk Science, Propaganda and Lies

DHHS’s Tom Novotny falsely attributes all cigarette smoking diseases, healthcare costs and lost productivity to “tobacco use” (to continue duping Americans to believe that all tobacco use is as harmful as cigarette smoking) on WHO’s World No Tobacco Day

CDC’s Brian King et al advocate banning all flavored tobacco products even though very low risk snus and moist snuff, and low risk cigars are significantly more likely to contain characterizing flavors than are far more harmful cigarettes.

NIH funds Univ of Arizona professor Judith Gordon and Oregon Research Institute’s Judy Andrews to deceive youth about vaping

“Right now, kids think there’s no risk in using e-cigarettes, so we want to make sure they understand the dangers involved, not only now but in the future. We want to teach them what e-cigarettes are, and change their perceptions of the device. For example, they don’t even know there’s such a thing as second-hand vapor,” said Dr. Gordon.

DHHS funded THR opponent John Pierce et al, vapor prohibitionists at Pediatrics, and UCSD press release claim PATH data found vapor ads may encourage teens to smoke cigarettes, but fail to acknowledge PATH data finding vaping has helped many smokers quit smoking, and that vaping is a gateway away from smoking (not towards smoking) http://pediatrics.aappublications.org/content/early/2017/05/18/peds.2016-3353

DHHS funded vaping opponents criticize e-liquid companies for NOT posting warnings (four months before FDA’s Deeming Rule went into effect) that falsely claim vaping nicotine is addictive (as there is no evidence that vaping has addicted any never smoker, and because “addiction” requires both dependence and harm to the user)

DHHS and Bloomberg funded Joanna Cohen at Johns Hopkins and BMJ advocate the enactment of unconstitutional (in the US) plain packaging cigarette laws abroad despite no evidence Australia’s law reduced cigarette consumption or smoking rates

DHHS funded tobacco control extremists Peter Shields et al urge FDA to make cigarettes more harmful (by banning cigarette filters), cite increase of one type of lung cancer (after filters were added to cigarettes) but ignore significant overall decline in lung cancer, heart disease and all cause death rates among smokers (after filters were added to cigarettes).

DHHS financed Peter Shields (who authored recent US tobacco cessation guidelines that falsely claims vaping doesn’t help smokers quit smoking) urges FDA to ban filtered cigarettes, claims doing so will reduce lung cancer rates among smokers.

News media hype claim by DHHS funded Peter Shields et al that filtered cigarettes increased cancer rates among smokers, and that banning filters would reduce cancer rates, without any fact checking and without interviewing any objective experts that disagree.

22nd Century touts US government purchase of 2.4 million additional very low nicotine cigarettes, touts DHHS funded junk studies of very low nicotine cigarettes to promote FDA cigarette prohibition (i.e. by banning sales of all cigarettes except  22nd Century’s very low nicotine cigarettes, which smokers won’t buy or smoke)

Trump says Francis Collins will stay on at the NIH

In January 2017, NIH Director Francis Collins deceptively touted FDA’s vapor Deeming Ban and Stan Glantz’ lies about vaping, and made the following false claims:

– vaping causes asthma and respiratory infections (despite zero scientific evidence),
– teen e-cig use is increasing (except the 2016 MTF found a 29% decline since 2014),
– there is “no evidence” e-cigs have contributed to sharp decline in youth smoking

– e-cigs have addicted more teens to nicotine (after the 2015 NYTS found <.1% of teen never tobacco users had used an e-cig on 10 or more of past 30 days)

US DHHS Budget

Trump Administration budget for DHHS mentions tobacco harm reduction in FDA CTP’s title (pg 18) REDUCING THE USE AND HARMS OF TOBACCO and description “decreasing the harms of tobacco product use”, but still falsely claims “Tobacco use is the leading cause of preventable disease, disability, and death in the United States” (as daily cigarette smoking, not tobacco or nicotine use, is the leading cause of all those things); CTP’s budget increase is from user fees by tobacco companies.

Trump budget would reduce funding for NIH (pg 36), which has intentionally deceived the public about THR products for decades, and gave more than a billion dollars to hundreds of anti-THR researchers/activists at dozens of universities to demonize and misrepresent risks of lifesaving vapor products, very low risk smokeless tobacco, nicotine, flavorings, cigars/pipes, and lobby for the TCA (2000-2009), FDA’s vapor bans (2009-present), vaping/tobacco use bans, banning nearly all nicotine in cigarettes, etc.

Trump budget reduces CDC’s Chronic Disease Prevention and Health Promotion funding (pg 28), much of which was wasted by Obama’s CDC to deceive the public about THR products and to lobby for FDA’s Deeming Reg, vaping and smokeless tobacco usage bans. Trump budget also reduces Prevention and Public Health fund (pg 28), that was used by Obama’s CDC to deceive the public about very low risk THR products and to lobby for vaping bans, smokeless tobacco use bans, FDA’s Deeming Regulation, etc.

Note that CDC’s Prevention and Public Health Fund spent $495.3 million since 2012 on “Tobacco Use Prevention” (i.e. $126M-2016, $111M-2015, $105M-2014, $60.3M-2013, $93M-2012), and Tobacco Use Prevention funds’ purpose was: “To raise awareness and shift key attitudes and beliefs about the harms of tobacco use and exposure to secondhand smoke in areas of the country with some of the highest rates of tobacco use prevalence.”

Big Pharma financed CTFK’s Matt Myers makes many false fear mongering claims about Trump’s budget impact on CDC’s ability to reduce smoking, deceitfully conflates lifesaving vapor products and very low risk smokeless tobacco with deadly cigarettes

Vapor prohibitionist Legacy lies initiative’s Robin Koval hypocritically calls Trump’s budget “a reckless threat to defund essential programs that address the number one cause of preventable death in our country”, while deceitfully conflating the negligible risks of vaping and smokeless tobacco use with the very high risks of cigarette smoking.

After lying about vaping to lobby for vaping and FDA vapor bans, Obama’s CDC Director Tom Frieden claims Trump’s budget would “increase illness, death”, while FDA/NIH and Big Pharma funded American Heart Association (that has also lied about, and lobbied to ban vaping and vapor products since 2009) claims Trump’s budget is “devastating” and “unconscionable”.

Environmental extremist group Sierra Club criticizes Trump Administration for its DHHS hiring freeze (which hopefully includes jobs to promote FDA’s vapor Deeming Ban, vaping bans, propaganda about vapor, smokeless tobacco, nicotine, flavorings, etc.)

WHO Extremism

WHO continues to deceitfully conflate any/all tobacco use with daily cigarette smoking to promote its annual World No Tobacco Day, lies about risks/benefits of different tobacco products, demonizes all things tobacco as anti-environment, anti-development.

“Tobacco threatens us all,” says WHO Director-General Dr Margaret Chan. “Tobacco exacerbates poverty, reduces economic productivity, contributes to poor household food choices, and pollutes indoor air.”

Colorado Health Dept’s Dr. Larry Wolk outrageously urges smokers to NOT switch to vapor products, repeats many fear mongering lies about vaping, hawks Big Pharma drugs

USA Today headline, article scare readers by falsely claiming 3rd hand smoke is harmful

Imperial Tobacco Canada’s Eric Gagnon exposes irrational contradictions in Canada’s tobacco and marijuana laws, wisely advocates THR products and policies, but falsely claims “smoking marijuana has similar health risks to smoking tobacco.”

ASH complains smoking isn’t declining fast enough in the US (after ASH lied about vaping and urged FDA to ban lifevapor products since 2009), advocates banning  flavored smokefree products, more government subsidies for ineffective Big Pharma nicotine, more government funding for anti-tobacco/vapor propaganda, enactment of unconstitutional WHO FCTC advertising bans, etc.

Vapor prohibitionist Legacy lies initiative deceitfully conflates the nonexistant cancer risks of vaping, the negligible cancer risks of smokeless tobacco use, and the very low cancer risks of cigar/pipe smoking with the huge cancer risks of cigarette smoking.

Vapor prohibitionist Legacy lies initiative and Steven Schroeder claim smoking is a social justice issue, but fail to acknowledge vaping is a social justice and human rights issue (because Obama’s FDA’s banned vapor products and lied about them since 2009).

Tobacco controllers and ASCO deceitfully conflate any/all tobacco use with cigarette smoking, deceitfully claim there is insufficient evidence to conclude vaping can help smokers quit smoking, praise WHO FCTC (that opposes smokefree THR alternatives).

After protecting cigarettes by lobbying to ban very low risk snus and vapor products, Hong Kong’s Dr. Judith Mackay hypocritically touts herself as a public health activist

THR Surveillance

ASH UK 2017 survey of adult vaping in Great Britain (England, Scotland, Wales) finds:

– 1.5 million of GB s 2.9 million vapers have quit smoking,

– 9.5% of ex-smokers vape in 2017 compared to just 1.1% in 2012,

–  .3% of never smokers vape in 2017 compared to .1% in 2012,

– 52% of GB vapers are exsmokers

– 45% of GB vapers are current smokers,

– 3% of GB vapers are never smokers,

– 6% of GB vapers vape >20mg/ml nicotine (that is now banned by the EU TPD, and that will reduce smokers  chances of switching to vaping and quitting smoking)

– the growth of vaping among GB smokers has slowed down sharply,

– 20% of GB vapers vape >4ml of e-liquid daily (bottles of which were recently banned by the EU TPD)

– just 13% of GB adults now correctly believe vaping is far less harmful than smoking cigarettes, compared to 21% in 2012, (due to fear mongering lies by vapor prohibitionists that have been deceitfully touted as facts by Big Pharma shills, medical associations, etc.)

– 26% of GB adults now inaccurately believe vaping is as harmful or more harmful than smoking cigarettes, compared to 7% in 2013 (also due to lies by vapor prohibitionists) http://ash.org.uk/media-and-news/press-releases-media-and-news/large-national-survey-finds-2-9-million-people-now-vape-in-britain-for-the-first-time-over-half-no-longer-smoke/

Brad Rodu: Vaping in the UK

Vaping research experts highlight key finding of 2014 Eurobarometer survey (i.e. current and former smokers are >50 times more likely than never smokers to vape daily, as 2.31% of current smokers and 2.18% of former smokers vaped daily, while just .08% of never smokers vaped daily, and just .04% of never smokers vaped nicotine daily); criticize junk studies that deceptively mix all/many experimental vapers (i.e. ever and/or past month users) with daily vapers to falsely conclude/claim that vaping has hooked many never smokers, leads to smoking, and isn’t an effective way to quit smoking.

US Congress

HR 2194 introduced by Rep. Duncan Hunter (R-CA) To protect the public health by providing the Food and Drug Administration with certain authority to regulate e-liquids and personal electronic vaporizers, to reduce the morbidity and mortality resulting from cigarette smoking through the responsible regulation of e-liquids and personal electronic vaporizers as a tobacco harm reduction strategy, and for other purposes. Referred to House Energy and Commerce Committee.

HR 2194 would amend 2009 Family Smoking Prevention and Tobacco Control Act to:

– Exclude vapor products from being defined or regulated by FDA as tobacco products,

– Authorize and require FDA to reasonably and responsibly regulate e-liquids and personal electronic vaporizers,

– Require e-liquids to comply with AEMSA standards http://www.aemsa.org/standards/,

– Require personal electronic vaporizers to comply with electronic and battery standards,

– Require serial numbers on, and tracking of, all e-liquid and electronic vaporizers,

– Require all e-liquid and electronic vapor product manufacturers to certify to FDA that their vapor products are in compliance with new FDA standards,

– Authorize FDA to impose penalties and ban products not in compliance with standards,

– Ban the sale of personal electronic vaporizers and e-liquids to anyone under 18 years,

– Authorize FDA to ban the advertising and promotion of vapor products to minors,

– Preempt states from enacting/enforcing any law regarding the manufacture, warning requirements, marketing, distribution, or sale of vaporizers or e-liquid that is different,

– Change name of FDA s Center for Tobacco Products to FDA s Center for Tobacco Products and Tobacco Harm Reduction, and require FDA to support harm reduction, and

– Require FDA to comprehensively assess and rank different types of tobacco and nicotine products based upon their comparative disease risks, and to recommend harm reduction strategies to Congress.

Smokeless Tobacco Litigation

UST urges court to dismiss lawsuit by Tony Gwynn s family because there is no evidence salivary gland cancer (which is what caused Gwynn s death) is associated with smokeless tobacco use, but even if it was, the risks of smokeless tobacco use have been well known (as DHHS and Big Pharma shills have deceived 90% of Americans to inaccurately believe smokeless tobacco use is as harmful as cigarette smoking).

FDA awards $625 Million to True North Communications to deceive the public about the vastly different risks and benefits of different tobacco/nicotine/vapor products

DHHS Lobbying for FDA Deeming Ban

CDC financed Univ of North Carolina tobacco control propaganda campaign protects cigarettes by declaring war on all low risk vapor, smokeless tobacco and OTP manufacturers, retailers, advertisements and packages; deceitfully conflates lifesaving vapor and low risk OTP with deadly cigarettes; hawks Big Pharma nicotine, promotes junk science, advocates anti THR laws lobbied for by CTFK and other Big Pharma shills http://countertobacco.org/

CDC study confirms the vast majority of cigalike e-cigs sold at Nielsen tracked retailers contain nicotine (to lobby for FDA s mandated warning that falsely insinuates nicotine in vapor products has addicted lots of nonsmokers), fails to study premium vapor products (that are used by most vapers, including virtually all vapers who quit smoking)

Legacy lies initiative cites CDC s irrelevant cigalike sales data (that didn t include any data from vape shops or online vapor vendors) to challenge MTF survey finding that most youth who vape don t vape nicotine, yet again lobbies for FDA s Deeming Ban (without ethically admitting it bans sales of all lifesaving vapor products to adults).

Study finds just 15% of teen vapers reported primarily using cigalike e-cigs, debunking CDC s new study on cigalikes, whose authors claimed virtually all e-cigs emit nicotine https://academic.oup.com/ntr/article-abstract/doi/10.1093/ntr/ntx069/3077310/Type-of-E-Cigarette-Device-Used-among-Adolescents?redirectedFrom=fulltext

A Risk Assessment Matrix for Public Health Principles: The Case for E-Cigarettes

Study finds most Americans support larger warnings on cigarette packs (which the TCA required the FDA to implement, but which FDA has failed to do so in the past 5 years)

Common Ground (article on David Sweanor’s self funded THR advocacy and charity)

Health Research

Study finds daily smoking rate worldwide declined by 28.4% for men and by 34.4% for women from 1990-2015, down to 25.0% for men and 5.4% for women in 2015; find smoking caused 11.5% (6.4 million) of worldwide deaths in 2015. Decline in smoking could have been far greater if US FDA didn’t lie about and ban vapor products since 2009 and if WHO didn’t lie about vapor products and urged all nations to ban them.

Brad Rodu: The Human Toll of Anti-Tobacco Extremism

DHHS & DHHS funded Junk Science, Propaganda and Lies

Washington Post and Daily Mail hype CDC’s absurdly false claim that one in four youth are exposed to secondhand e-cigarette smoke (since e-cig vapor is smokefree), CDC’s Brian King keeps lying about vaping to lobby for more cigarette protecting vaping bans

FDA/NIH/NIDA funded anti vaping activists at Yale once again misrepresent their own findings (and those of many others) that teen smokers are far more likely to vape than nonsmokers to lobby for more FDA bans (beyond Deeming’s ban of all vapor sales)

FDA/NIH funded UT promotes junk study falsely claiming flavored e-cigs appeal to youth and young people (as flavored e-cigs appeal almost exclusively to smokers and former smokers who vape), repeats disproved false fear mongering claims about vaping

FDA/NIH funded anti vaping activists at UC San Diego continue to misrepresent the huge benefits and negligible risks that lifesaving vapor products provide for smokers

More Junk Science, Propaganda and Lies

GWU students (using 2014 NHIS data) find vapers reported far lower rate of heart attacks than smokers and exsmokers, find increased odds ratios of .42 for vapers, 2.75 for daily smokers, 2.39 for some day smokers, 1.80 for exsmokers compared to never smokers; but authors falsely claim vaping increased odds of MI by 42% and fail to admit that >93% of vapers surveyed were current or exsmokers (whose odds sharply declined).

Junk scientist and vaping prohibitionist Stan Glantz touts study done by GWU students finding vapers had a 42% higher odds ratio for heart attacks than never-vapers, but also fails to acknowledge that >93% if vapers surveyed were current or former smokers.

Big Pharma funded ACS’ Jeffrey Drope falsely claims “Big Tobacco is now dominating in dollars of sales” of vapor products, complains that tobacco companies are cornering the vapor market, while failing to acknowledge the FDA Deeming Ban (that ACS lobbied for since 2011) protects cigarettes and gives the entire vaping industry to Big Tobacco.

Big Pharma funded ALA’s Deb Brown criticizes NJ Gov Chris Christie for not wasting taxpayer dollars on anti THR propaganda or for costly and ineffective smoking cessation programs and subsidization of Big Pharma drugs; yet again fails to ethically disclose ALA’s irreconcilable financial conflict of interest as a Big Pharma shill.
