News: EJM Certificate Conformity

The Child Nicotine Poison Prevention Act of 2015 gave the Consumer Products Safety Commission (CPSC) authority over liquid nicotine containers and packaging. The U.S. Consumer Product Safety Commission issued a letter dated July 22, 2016 revising industry guidance on The Child Nicotine Poisoning Prevention Act of 2015 (CNPPA).

The letter states “Upon further legal analysis, CPSC staff has determined that the CNPPA applies to existing inventory [emphasis mine] on its effective date. Thus, beginning on July 26, 2016, the sale of liquid nicotine in non-compliant containers is prohibited. In a previous letter, U.S. Consumer Product Safety Commission (CPSC) staff stated that this requirement applies to products packaged after the effective date of July 26, 2016.”

This means all e-liquid inventory sold by any retailer, wholesaler or manufacturer as of July 26, 2016 must be compliant with US 16 CFR Title 16 Part 1700.20 - regardless of when it was manufactured.

This certificate references tests from 2013 through June 2016, and remains valid for a period of ten years from confirmation date provided no design or material modifications are made to closure product.
